Podgorica, Montenegro (10 October 2019) -- At its 138th session, the Montenegrin Cabinet passed the Draft Law on Public - Private Partnership. The aim of the new law, which uniquely regulates this area, is, first of all, to create an environment for the growth of public-private partnership projects, improve the quality of services and jobs of public interest, as well as economic growth and create conditions for new employment.

The Cabinet also passed the Draft Law amending the Law on Concessions. The new provisions standardise a number of practice issues that have hitherto been addressed by the provisions of the concession agreement, especially those relating to the means of security and the manner of securing the subject of the concession.

Within the framework of harmonisation of national legislation with the regulations of the European Union, the Government passed the following draft laws: the Draft Law on Credit Institutions, Draft Law on Rehabilitation of Credit Institutions, Draft Law on Deposit Protection and the Draft Law amending the Law on Bankruptcy and Liquidation of Banks.

Draft Law on Credit Institutions implements a directive aimed at establishing harmonised national regulations regarding access to the activities of credit institutions and investment firms, management modalities for these institutions and a framework for their supervision.

Draft Law on Rehabilitation of Credit Institutions creates conditions for the introduction of a European resolution system, which should provide the resolution authorities with instruments for early and prompt intervention in a troubled credit institution, in order to ensure the continuation of key financial and economic functions of the credit institution, at the same time minimising the impact of a credit institution's collapse on the economic and financial system and minimising the possibility that taxpayers will ultimately be reimbursed.

Draft Law on Deposit Protection brings into the Montenegrin legislation a deposit protection system, regulated by a European directive, which aims to protect depositors from the consequences of a protected event, i.e., the consequences of bankruptcy of credit institutions, to preserve the confidence of depositors and to contribute to the stability of the banking and overall financial system.

Draft Law amending the Law on Bankruptcy and Liquidation of Banks aligns with the European Union Directive, which regulates the order of priorities, so that individuals, micro, small and medium-sized legal entities should receive more favourable treatment than other creditors.

In order to ensure implementation of the Law on Food Safety and full compliance with the European legislation, the Government adopted the Regulation amending the Regulation on additives that can be used in food, as well as the Regulation amending the Regulation on novel foods that can be used and placed on the market.

Today’s Cabinet session adopted the Information on the Proposal of the Support Package for NATO Information and Communication Services to the Military Representative in the Allied Command Operations (ACO) for 2019, and accepted the Support Package, which is adopted annually for the needs of the Office of the National Military Representative of Montenegro in the Allied Command Operations (ACO).

The Government adopted the Information on the Financing Agreement between the European Commission, Bosnia and Herzegovina and Montenegro for 2018 and the Partnership Agreement on Implementation of the Technical Assistance Priorities under the IPA II Cross-border Cooperation Program Bosnia and Herzegovina - Montenegro 2014-2020, and adopted the texts of the agreement.

The Cabinet adopted the Decision on the setting up the Tender Commission for the opening and ranking of tenders submitted on the basis of the Public Invitation for the long-term lease of state-owned land with a view to building a wind farm on the Brajići location.

The Government adopted the Concession Act for granting a concession for the use of a part of water for the technological needs of the Coal Mine AD Pljevlja for the system of dust removal from the Ćehotina River, in line with the DTO system relocation project. The concession act contains data, information and analyses related to the granting of the concession, the activities and obligations of the bidder during the public bidding, as well as the conditions and obligations that the concessionaire must fulfill during the performance of the concession activity. On this occasion, the Government tasked the Water Directorate to, in accordance with the Law on Concessions, invite a tender for granting a concession for the use of a part of water for the technological needs of the Coal Mine AD Pljevlja for the system of dust removal from the Ćehotina River, in line with the DTO system relocation project.

The Cabinet adopted the Concession Act for awarding a concession for the use of a part of the water from the source "Komunica", Municipality of Danilovgrad, for bottling, i.e., packing or delivery of water for commercial purposes.

The Government adopted the Information on the organisation of the event "Montenegrin Doctors in the Diaspora". As the discussion stated, this event will take place to educate health professionals, engage them and keep them in the health system.

The Government passed the Statute of the Environmental Protection Fund. The Statute stipulates that the Fund is a one-member limited liability company, that the main activity of the Company is to perform professional and other tasks related to financing the preparation, implementation and development of programmes, projects and similar activities in the field of conservation, sustainable use, protection and improvement of the environment, at the state and local level. The Eco Fund will pool all the resources that come from environmental pollution and, by liaising with international institutions, make additional funding available.

The Government appointed Radule Raonić Advisor to the Prime Minister.
